If I deposit my initial settlement check does that mean I am accepting the amount and my claim is closed?
 
This is a great question. In almost every insurance claim you can deposit the check and it does not mean that you are agreeing to the settlement. You still have the right to request additional money for damages that were not covered. However, there are specific Insurance Companies who will try to be unethical by putting small print on the back of your check. This language they will attempt to use will say that you agreed to the settlement offer. Always look at the check in its entirety before depositing. In our opinion this is a completely unethical business practice. And if you make a mistake and deposit a check with this language we recommend you consult and attorney.
 
The language will usually will state something like this on the back of the check.
 
“ENDORSEMENTS”
 
“The endorsement of this draft by payee(s) constitutes a receipt and release in full settlement for the claim or item mentioned in the draft.”
